In a used store online in my country I found a fake selmer ref54, announced has the real deal. I contacted them saying it is a fake and to warn them because selling stuff like this, even unknowingly is against the law.

They answered me that they pass all bought goods through a check and control of quality and authenticity (yeah, right), hinting that I'm the one who is wrong... So, how should I address this further? I don't really want anyone to be scammed thinking it to be legit.

Contact the authorities in your country who deal with the passing-off of obviously fake/counterfeit goods. Surely Portugal has some sort of "consumer protection bureau" or something. Call the shop out online. That horn is obviously not a Ref. 54 and to attempt to pass it off as such is willful blindness at best and predation at worst.

Also contact Selmer.

If you were producing a product worth thousands of Euro, wouldn't you want to know if there were fakes out there, who is selling them, what they look like, and where they're coming from? More importantly: Selmer would be the party that could potentially bring legal action against the seller/shop.

In reality, it will probably achieve very little, but it's not a bad thing to do. It takes 5 minutes to write an e-mail to Selmer with a link/pics and the information of the shop in question.

Good on you for catching this and wanting to take action.

I understand what you are saying, but this is not the problem, just a symptom. Selmer is well aware of the problem, and this is not a shop buying counterfeit products to sell them new, but a used products shop that buys from people to re-sell, a pawn shop of sorts.
